Committed to stand trial

A FORTY-EIGHT-year-old Bathurst man has been committed to the District Court for trial over the alleged possession of child pornography.

Richard John McPhillamy, of Laws Place, Bathurst has been allowed strict bail conditions by Bathurst Local Court Magistrate, Jan Stevenson until he appears again next month at the Bathurst Court House.

Director of Public Prosecutions trial advocate, Beth Walker last week filed a second brief of evidence against McPhillamy on 44 counts of possession of child pornography.

Ms Walker alleged that McPhillamy had been found in possession of pornographic images by police from Strike Force Belle investigating allegations involving former staff at St Stanislaus’ College.

The pornography charges all relate to alleged offences between February and December last year, in Bathurst.

Early in September, Ms Walker foreshadowed laying the pornography charges against, McPhillamy a former member of St Stanislaus’ College staff.

She told the court then that McPhillamy had been arrested on Monday, December 15 on two counts when given bail. Four additional charges had been laid against him on Monday, June 15.

Police said a search had been carried out on December 9 when they allegedly seized photos from McPhillamy’s home, of boys on bunks in the college dormitory.

The allegations against McPhillamy also relate to alleged possession of class photos, sports teams and altar boys from St Stanislaus’.

According to police they initially found 16 pornographic photos but further analysis of a computer allegedly uncovered 42 images of young boys aged 10-15 years that police alleged ranged from five to seven on a Copine scale range for matters of pornographic seriousness. The pornography allegations were contained in the second of two sequences of charges, Ms Walker said would proceed to trial before the District Court.

McPhillamy’s strict bail conditions require him to report daily to the officer in charge of the Bathurst Police, reside in Laws Place, not partake in any activities relating to minors, not contact alleged victims and surrender his passport.
