Stannies’ sexual assault trial set to begin today

THE trial of a Bathurst man over sexual assault allegations at St Stanislaus' College has been listed in Sydney today .

Richard John McPhillamy, 48, who was arrested by police after attending the Bathurst Police Station in December, 2008 has pleaded not guilty to four sexual assault charges dating back 25 years.

The first of two trials of the former St Stanislaus' staff member has been listed before Judge R. Solomon, at the Downing Centre.

McPhillamy has been committed to stand trial on two sequences of charges, this week's trial on sexual assault allegations and a second trial on pornography allegations listed for April 12.

The first trial relates to allegations of homosexual intercourse with a male between 12.01am on October 1, 1985 and 11.59pm on December 31, 1985 and three allegations of sexual assault with acts of indecency, alleged to have occurred in the same time frame, with a 13-year-old boy.

McPhillamy of Laws Place, Bathurst entered not guilty pleas at separate paper committal hearings in Bathurst Local Court last September and October.

He was first ordered to stand trial on sex allegations and a month later over alleged possession of pornographic images.

Police carried out a search on December 9, 2008 when they allegedly seized photographs from McPhillamy’s home, pictures of boys on bunks in a college dormitory.

The allegations against McPhillamy also relate to alleged possession of photos of classes, sports teams and altar boys from St Stanislaus'.

According to police they initially found 16 pornographic photos, but further analysis of a computer allegedly uncovered 42 images of young boys aged 10-15 years.

Police allege these photos ranged from five to seven on a Copine scale range for matters of pornographic seriousness.

McPhillamy has been on bail pending his trials in Sydney. He has had to report daily to police while residing in Bathurst and not take part in any activities relating to minors, not contact alleged victims and surrender his passport.
