A MAN who threatened police, telling them he’d track them down when they were off duty and kill them, has received two wholly suspended sentences after being convicted of resisting police and intimidating an officer in the execution of duty.

Shaine Dowd, 23, of Tyndall Street appeared before Magistrate Michael Allen in Bathurst Local Court on Monday.
Police facts tendered to the court told how on January 12 this year, they observed a white Rav following a female running along Boyd Street. Police stopped the pair, spoke to them and were told the woman was going to a home in Tyndall Street to retrieve her phone and other items as she feared they would be damaged. A short time later police went to the address and saw the female’s boyfriend entering the house and retrieving the items.
He walked outside and handed her the items, and police approached the woman to speak to her.
At this point Dowd exited the house and started yelling at police, wearing only his underpants. He was affected by alcohol. He told the police to “[expletive] off” as they walked away.
Dowd then continued walking towards police screaming “[expletive] off or I will stab you”, but then he pressed his forehead against the woman’s face, pushing her back into her car. Fearing a violent confrontation was imminent, police demanded Dowd let go of the woman. He continued to yell and swear at police, again threatening to kill them.
Police then directed a two-second burst of OC capsicum spray in Dowd’s face.
He ran inside, threatened to shoot police, but reemerged with what police believed was a bat.
“I’ll stab you and kill you,” he said.
Police then armed themselves with a taser and told Dowd to get on the ground. But he took his underpants off and exposed his penis and continued to threaten police and their children.
As police placed Dowd in the rear of their caged vehicle he continued to threaten them, saying he would find them off duty and stab them.
On the charge of resisting an officer he was sentenced to nine months imprisonment. On intimidating a police officer in the execution of their duty he was jailed for 18 months. Both these charges were wholly suspended under Section 12.
He was also ordered to undertake the supervision of the probation service.
On Monday, Dowd was also sentenced on two unrelated matters, affray, for which he received an 18-month jail sentence, and resisting an officer in the execution of their duty, for which he was jailed for nine months. Both were wholly suspended.
