A MAN found with cannabis and oxycontin has been convicted and fined after facing Bathurst Local Court.

John Patrick Kearney, 32, of Culnane Place in Kelso, appeared before magistrate Michael Allen.
Police facts tendered to the court told how on July 27, police received information that Kearney may be in possession of prohibited drugs.
Police applied for a search warrant and arrived at the house at 6pm where it was executed.
When police arrived, the wooden door was open but the screen door was locked, so police grabbed the screen door and ripped it open.
When police entered the house they found Kearney in the hallway and showed him the search warrant.
As police began searching the premises, they entered the lounge room where they found three plastic spoons, a roll of foil, some battery operated scales, a bong and a bowl of drugs, plus a pile of cash.
Police questioned Kearney about the money and he said he had $250 from Centrelink and change from McDonald’s.
He also told police he had just shot up heroin and used two caps a day.
Police then counted the cash, which came to $570, and seized the scales. They also photographed the money because they believed it came from the sale of heroin.
During their search of the remainder of the house, police found a clear plastic bag containing cannabis leaf in the kitchen.
Kearney told police the cannabis wasn’t his, saying “she left it at his house three weeks ago”.
On the possession of a prohibited drug, Kearney was convicted and fined $200, and Mr Allen ordered the drug to be destroyed.
On the second charge of possession of a restricted substance, Kearney was fined $100, with the drug ordered to be destroyed.
