Glenn Raymond Boatswain, 58, of Annesley Street, faced Bathurst Local Court on a string of serious charges.
But magistrate Michael Allen said he was unable to deal with the matters and adjourned the case to Parramatta on April 2.
The court was told Boatswain was a director and company secretary of GLMP Pty Ltd.
It has been alleged that Boatswain, trading as Boatswain Commercial and Industrial Real Estate, fraudulently converted $172,460.41 by transferring the money from the GLMP Pty Ltd, trading as BCI Real Estate Strata Trust, and put that money to his own use and use by GLMP Pty Ltd between September 5, 2009 and May 10, 2012 at Bathurst.
He has also been accused of fraudulently converting $52,862.75 from GLMP Pty Ltd, trading as Boatswain Commercial and Industrial Real Estate Strata Trust, and putting that money to his own use.
It is also alleged that the defendant company GLMP Pty Ltd, trading as Boatswain Commercial and Industrial Real Estate, failed in its duty to properly supervise the business of Boatswain Commercial and Industrial Real Estate between September 1, 2009 and May 10, 2012.
Boatswain has also been charged with one count of common assault and one charge of assault occasioning actual bodily harm after an incident at McDonald’s restaurant in Bathurst between 12.30am and 12.40am on October 26 last year.
Police allege that at around 12.34am, the victims, Jordan Collins and Adrian Ryan, walked towards the serving counter.
Police reported that as Mr Ryan walked towards the waiting line, CCTV showed he was slightly unsteady on his feet. As he approached the condiments bay, his arm made contact with the back of the accused, who was seated at a table.
The court was told CCTV depicts the accused immediately stand up, holding a cup in his left hand.
Police allege Boatswain accused Mr Ryan of attempting to pickpocket him, which Mr Ryan denied and apologised.
Police said Mr Ryan placed both hands in the air in a passive defence and, the accused, without being provoked, punched him to the mouth and cheek, causing him to stumble backwards.
Mr Collins moved to stand between the accused and Mr Ryan, questioning his actions, which allowed Mr Ryan to walk out the exit. Mr Collins was pushed to the chest before the accused followed Mr Ryan.
It is alleged the accused then punched Mr Ryan in the face again. The force of the punch caused him to hit the glass wind barrier and stumble back into the middle of the walkway. Police allege Mr Ryan used his arm to hold himself up before stumbling into the car park.
A female witness stood between the accused and Mr Collins and said: “Sorry that he bumped you but he is only drunk. He wasn’t trying to steal your wallet.”
Police allege Boatswain took a step forward and punched Mr Collins in the face, causing his nose to bleed.
On Thursday, December 5 police attended Boatswain’s home and placed him under arrest. He admitted that he had about 15 schooners of beer prior to the incident.
A pre-sentence report was requested and the matter adjourned to Parramatta Local Court. Bail will continue.
