A MAN accused of breaking into the historic St Barnabas’ Church in the minutes before it was severely damaged by fire has been bailed.

Patrick Johns, 34, of Aroo Street in South Bathurst, appeared before magistrate Michael Allen in Bathurst Local Court on Monday, charged with aggravated break and enter (commit a serious indictable offence) and a warrant breach for a community service order.
Johns was arrested by police on Friday and refused bail in a bail court hearing on Saturday. He re-appeared in custody before the court on Monday, where he was granted strict conditional bail.
Johns is facing an allegation of breaking and entering St Barnabas’ Church in Rocket Street between 1.13am and 2am on February 23 this year.
Once inside the church, police allege Johns committed a serious indictable offence, larceny in circumstances of aggravation. They further allege that at the time he was in the company of four people who were known to the informant.
Inspector Luke Rankin from Bathurst Police said earlier in the week the investigation into the fire which severely damaged the church was progressing well, although no one has yet been charged in relation to the blaze.
The prosecution opposed bail during Johns’ appearance in court on Monday, saying the charge was a serious offence, there was a strong prosecution case and, if convicted, Johns would likely face a custodial sentence.
However, Legal Aid solicitor Leigh Haywood argued her client had lived in Bathurst for most of his life and was employed full-time.
Mr Allen granted bail with strict conditions, adjourning the matter until May 19 for replies.
