Jason Edwin Brazel, 36, of Piper Street, Bathurst recorded a blood alcohol reading of 0.342 after he crashed his car into a roundabout in March this year.
He was subsequently charged with high range PCA second plus offence and appeared before magistrate Michael Allen in Bathurst Local Court last week.
Police facts tendered to the court revealed how at around 11.30pm on Wednesday, March 12, Brazel was driving his motor vehicle east along Durham Street when he collided with the roundabout at the intersection of Mitre and Durham streets.
As a result of the collision Brazel’s car sustained gouge marks and lacerations to the tyres, rendering it unable to be driven. Brazel stopped the vehicle about 100 metres up the road.
Police attended a short time later and as they arrived observed a skid mark 50 metres in length finishing where Brazel’s car came to rest. Police stopped at the car and found Brazel sitting in the driver’s seat, with the key still in the ignition.
He got out of the car to speak to police, who immediately formed the opinion he was severely affected by alcohol due to his inability to answer simple questions, as well as being unsteady on his feet and slurring his speech.
A roadside breath test produced a positive result, so police arrested Brazel and conveyed him to Bathurst Police Station, where he recorded a reading of 0.342.
In relation to his alcohol consumption, Brazel told police he had consumed “two or three white wines” between 3pm on Tuesday, March 11 and midday Wednesday.
As the reading fell into the high range, Brazel’s licence was suspended on the spot.
Mr Allen convicted Brazel, fined him $800 and disqualified him from driving for 30 months. He was also placed on a Section 9 Bond for a period of 18 months.
Mr Allen also ordered that Section 225 (3) of the Roads and Transport Act 2013, apply.
