Shaun Desmond Peters, 35, of Vittoria Street, West Bathurst did not appear before magistrate Michael Allen in Bathurst Local Court and his matter was dealt with ex parte under Section 196.
Police facts tendered to the court told how on April 14 this year police were conducting surveillance on a property on the Sydney Road in relation to the imminent execution of a search warrant.
While police were watching the property they observed Peters leave via the front gate and walk west along the Sydney Road. He was stopped by police 400 metres up the road.
After speaking to Peters, police indicated to him he would be searched.
During the search, police found a wallet which contained a small re-sealable plastic bag containing a crystalline substance.
Peters was cautioned by police, who then asked him about it. He told police: “It’s ice, I forgot I had it, shit.”
Peters confirmed to police the drug was ice and said it for his personal use.
Mr Allen convicted Peters, fined him $300 and ordered the drugs be destroyed.
