Michael Paul Hockley, aged 43, of Dempsey Street, Peel appeared before magistrate Michael Allen in Bathurst Local Court.
Police facts tendered to the court told how on May 18 this year Hockley had attended a work function at the Dudley Hotel and left at around 4pm to drive home. While on his way home, Hockley failed to negotiate a right-hand bend and two of the car’s tyres hit the gravel, causing him to lose control of the car.
Hockley’s vehicle careered onto the wrong side of the road before going up an embankment and colliding with a fence post, which caused the vehicle to roll onto its roof.
Police arrived at 4.25pm and spoke to Hockley, who they observed to be unsteady on his feet, smelling of alcohol and swaying backwards and forwards.
A roadside breath test produced a positive result, and Hockley was arrested and taken to Bathurst Police Station for a breath analysis, which recorded a reading of 0.153.
He told police he did not accept the result and requested a blood test be taken. Hockley was then taken to Bathurst Hospital for a blood test which produced a result of 0.175 grams of alcohol per 100 millilitres of blood.
