A MAN who failed to appear at court to answer charges of driving while disqualified, second plus offence, has had a Section 25 Crimes warrant issued against him.

Matthew Taylor, 24, of Carlingford Street, Bathurst, did not appear to answer charges of using an unregistered and uninsured class A vehicle, drive a motor vehicle during a period of disqualification (second plus offence) and rider without helmet with two passengers without helmets.
The matter was subsequently dealt with in his absence.
Police facts which were tendered to the court told how on April 18, a member of the public contacted police saying a man wearing a red shirt was riding an unregistered trail bike at the Windradyne Heights Reserve, and he had toddlers on the back of the bike without helmets being worn.
Police attended and observed Taylor on a thumper-style motorcycle with no helmet. They stopped the bike to speak to him and allowed the two toddlers to dismount the bike.
Police spoke to Taylor and he identified himself to them stating he had no driver’s licence and was disqualified from driving.
The bike he was on was a 125cc motorcycle which cannot be registered in NSW.
Taylor told police he did not know it was illegal to ride in the nature reserve and told them “he was only riding slow in the park area”.
He also told police he did not know it was an offence for the toddlers to be on a bike without a helmet. When police questioned him about the apparent danger he was putting the children in by not wearing a helmet, he agreed with this.
Police carried out checks on his licence status which confirmed he was a disqualified driver, and they told Taylor he would be issued with a Field Court Attendance Notice as a result.
At this point, Taylor became angry and started yelling at police saying “do what ever you [expletive] want, I don’t give a [expletive]”.
Magistrate Michael Allen dealt with the use an unregistered and uninsured Class A motor vehicle by way of a $300 fine on each matter. On the charge of rider without helmet with two passengers without helmets, Mr Allen also fined Taylor $300.
For the drive motor vehicle during a period of disqualification (second plus offence) Mr Allen convicted Taylor and issued a Section 25 (2) Crimes Warrant.
