Douglas Allan Dodds, 40, of Patterson Place in Kelso appeared before magistrate Michael Allen on July 28.

Police facts tendered to the court told how on March 7 this year Dodds was travelling on a Countrylink train with members of the public when he became verbally abusive towards staff and fellow passengers.

Countrylink staff informed him that because of the way he was behaving, he would be put off the train when it reached  Wellington.

Dodds refused and police were called.

At Wellington, police introduced themselves and told Dodds to get off. He refused, so police took hold of each of Dodds’ arms and escorted him from the train. However, as he got off the train, Dodds dropped his body weight and fell to the ground.

Paramedics were called to check on his health and when they arrived Dodds sat up and started swearing at police, calling them “you [expletive] white [expletives], I will smash your [expletive] in you dogs.

“You don’t even know me you [expletives] I’ll remember your face you dirty dog.”

Dodds then stood up and continued his rant at police saying: “I will kick you in the [expletive] you coppa [sic] dog.” 

Police then took control of Dodds’ arms to prevent an assault. He thrashed around violently and police had to physically hold him down.

Dodds began to kick out at officers and then spat on one of the officers as he tried to arrest him.

He then spat in the face of a second officer as he was trying to load him into a caged vehicle.

On the two charges of assaulting an officer who was executing his duty, Mr Allen convicted Dodds and placed him on a Section 9 Bond for a period of 12 months. The offensive language in a public place and resist an officer in the execution of their duty charges were dealt with under Section 10A.
