Nathan Mukilli Akamarmoi, aged 21, of Barnhill Road, Terrigal, appeared before magistrate Michael Allen on July 28, charged with assault occasioning actual bodily harm.
Police facts indicated Akamarmoi, a student at Charles Sturt University, attended a function at the Edinboro Hotel in William Street on March 19 this year. The function had a beach party theme and there was sand on the dance floor.
Some time between 10.45pm and 11.15pm Akamarmoi and the victim were dancing when a heated verbal argument broke out.
The accused reached down and grabbed a handful of sand and threw it up in the air. The victim then picked up some sand and threw it back.
One of the victim’s friends abused Akamarmoi and started clapping in his face.
Akamarmoi told the victim: “If you keep clapping I will hit you.” The victim again clapped and Akamarmoi headbutted him in the face.
The victim was driven to Bathurst Base Hospital and treated for a clinically fractured nasal bone and a half-a-centimetre skin split in his nasal bridge.
Mr Allen imposed a bond and ordered Akamarmoi to be of good behaviour for 12 months.
