The man was charged yesterday evening with manslaughter and recklessly cause grievous bodily harm.
He was refused bail and will appear in Mudgee Local Court today.
A 40-year-old Oberon woman has already been charged with the child’s murder.
She appeared before Blayney Local Court on Tuesday, where she was remanded in custody until her next court appearance, via AVL, in Bathurst Local Court on November 10.
She has yet to enter a plea in relation to the charge.
Chifley Local Area Command crime manager, Detective Inspector Luke Rankin, said the child died at Westmead Hospital on August 6 and, since his death, Chifley Local Area Command detectives, assisted by the State Crime Command, have been investigating the events leading up to it.
Police and NSW Ambulance paramedics were called to a house in Cunynghame Street, Oberon around 3pm on August 3, where they found the toddler unconscious and not breathing.
Officers performed CPR on the boy before he was airlifted to Westmead Children’s Hospital in a critical condition; he died three days later.
At the time, police were told the little boy was injured after becoming tangled in dog leads and falling.
Detective Inspector Rankin said the team investigating the toddler’s alleged murder were committed to getting to the bottom of what happened.
When asked about the nature of the child’s injuries, Detective Inspector Rankin said he was unable to comment as that was a matter for the court.
Detective Inspector Rankin said the investigation remains ongoing and appealed to anyone with information about the child’s death at Oberon, or the events leading up to it, to call Bathurst Police or Crime Stoppers on 1800 333 000.
