Kellie Marie Morgan, aged 33, of McPhillamy Avenue, Gorman’s Hill appeared before magistrate Michael Allen in Bathurst Local Court last week, charged with drive while licence refused, first offence.
Police facts tendered to the court told how on May 23 this year Morgan was pulled over by police for a random breath test on the Mitchell Highway, opposite the Bathurst Golf Club.
Police stopped Morgan’s vehicle and asked for her driver’s licence.
She told police: “I only got my learner’s one here, I just been to the RTA to get me licence back but they wouldn’t give it to me because of demerit points or something.”
Morgan then took a roadside breath test which produced a negative result.
Police conducted checks with the RMS database and found Morgan had been disqualified from driving by court order for a period of 12 months from May 22, 2013 to May 22, 2014 for a PCA offence.
Police also confirmed Morgan had attended the RMS before being stopped by police, however, her licence was refused by the RMS for excess demerit points.
Mr Allen dealt with the matter by way of a Section 10A, disqualifying Morgan for a period of 12 months, effective September 8, 2014.
