A MAN who drove while disqualified has been jailed for seven months, which was then wholly suspended under Section 12, after appearing before Bathurst Local Court for the second time in a week.

Zac Raymond Kessey, aged 18, of Larson Street, West Bathurst, appeared before visiting magistrate Dorelle Pinch on Monday to answer charges of never licensed person drive on road, for which he was placed on Section 9 Bond for a period of 12 months; using vehicle in breach of a minor defect notice, for which he was fined $100, and resisting an officer in the execution of duty, for which he was placed on a Section 9 Bond for a period of 12 months.
As part of the Section 9 Bond, Ms Pinch marked Kessey’s papers that he was not to occupy the driver’s seat of a car, for any reason whatsoever.
But Kessey was back in court again on Tuesday morning after being picked up by police on Monday afternoon driving his mother’s car.
Police facts tendered to the court told how at 1.30pm on Monday police, who were patrolling Hill Street, observed a Holden Barina doing a U turn in Cummings Street into Hill Street before accelerating harshly into Larson Street and pulling into a driveway.
Police pulled in behind the car and saw Kessey exit the driver’s seat and a woman get out of the passenger seat.
As police approached Kessey he became very aggressive and punched the car.
Police told him to calm down and asked him to explain what was going on.
He told officers he had “just finished court” and, when asked if he had a driver’s licence, he said “no”.
He was unable to produce identification, but told police his name was Zac Kessey.
When they asked why he was driving, he told officers he was “taking the car home for his mother”.
Police again told Kessey to calm down, and due to the level of his aggression they handcuffed him. Police facts also stated that family members were surrounding police.
While being placed under arrest Kessey admitted to police he was on a bond which stipulated he was not to occupy the driver’s seat of a car. He was arrested by police but declined an interview.
Police facts indicated that on July 25 this year Kessey was disqualified from holding a driver’s licence until August 25, 2017.
On the charge of driving a motor vehicle during a period of disqualification Ms Pinch convicted Kessey, jailing him for a period of seven months and wholly suspending the sentence under a Section 12 Bond.
