A 68-YEAR-OLD man accused of assaulting a serving female police officer when she stopped him for a random breath test was suffering paranoid delusions, Bathurst Local Court has heard.

Ross Campbell Lindsay, of Cross Street, Bathurst, was again granted bail following a short court appearance yesterday.
He is facing two counts of assaulting a police officer in the execution of their duty; one count of assaulting a police officer in the execution of their duty causing actual bodily harm; and two counts of resisting/hindering police in the execution of their duty.
Police prosecutor Sergeant Beau Riley told Magistrate Milovanovich that Lindsay, himself a former police officer, believes the police had him under surveillance.
“He poses a significant risk to himself and police,” Sergeant Riley said.
“His brother is here today and he has some very serious concerns for his mental health.”
Lindsay has pleaded not guilty to all charges.
Sergeant Riley reminded Mr Milovanovich that he had the power to order that Lindsay be taken to a local psychiatric unit or hospital for assessment under the Mental Health Act.
However, Mr Milovanovich said he did not see how he could do that.
“It would be different if he was behaving in a certain manner in court,” he said.
Lindsay has been charged with assaulting two police officers between 4.15pm and 4.18pm on December 26 at Bowenfels.
A female officer was treated for facial injuries as a result of the assault.
He was granted unconditional bail on December 27 by a chamber magistrate.
At the time, police opposed bail because of the serious nature of the offences and his alleged delusional state of mind.
The bail hearing was told that Lindsay is a former police officer who left the force in 1999.
Solicitor Leigh Haywood indicated yesterday that the matter would proceed to hearing, adding that it would be best for all concerned if the matter was expedited.
The case was adjourned to February 16. Mr Milovanovich ordered that bail continue.
