A MAN caught driving a car while his licence was disqualified received a conditional discharge after appearing before Bathurst Local Court recently.

Mohamed Albareeni, 24, of St Ann Street, Merrylands, appeared before visiting magistrate Bruce Williams in Bathurst Local Court, charged with driving a motor vehicle while his licence was suspended.
Police facts tendered to the court told how on November 7 last year police were patrolling the O’Connell Road when they observed a silver Ford Falcon travelling well above the signposted speed limit. A subsequent speed check of the vehicle revealed it was travelling at 99km/h in a 60km/h zone.
Police activated their warning lights and stopped the vehicle. They approached the driver, but were informed he didn’t speak English and a passenger in the car would have to translate.
Police then informed the driver that the conversation was being recorded and could be later used as evidence in court.
Officers asked for the driver’s licence and were handed an International Driver’s Licence and Proof of Age card.
Police were able to confirm Albareeni’s identity, but checks in relation to his licence status were inconclusive.
They spoke to the accused in relation to his speeding via the translator. Police were told Albareeni was unaware the speed limit had changed from 100km/h, although he had passed numerous speed signs. Officers issued a traffic infringement notice in relation to exceeding the speed limit and police then informed Albareeni that if there was an issue with his licence status, which police suspected there was, he would hear from police by way of a Field Court Attendance notice.
A subsequent check of Albareeni’s licence revealed it was suspended by Goulburn Highway Patrol on July 31, 2014 for an over 45km/h speed offence, with the suspension ending on January 30, 2015.
Mr William dealt with the matter by way of a conditional discharge, place Albareeni on a Section 10 Bond for a period of nine months.
