Pamela Jane Gordon, 22, of Alpugi Place in Kelso, appeared before magistrate Michael Allen in Bathurst Local Court on Tuesday charged with common assault, and two counts of assaulting an officer in the execution of duty, resist an officer in the execution of their duty.
Police facts tendered to the court told how on December 7 last year, police were called to Alpugi Place in relation to the victim, who wanted her daughter [Gordon] removed from the location due to her level of intoxication.
Gordon was subsequently removed and taken to a property in Culnane Place.
At 3.10am the next morning, police were again called to the victim’s properly after Gordon returned. Again the victim wanted police to “get rid of her”.
Police entered the house and saw Gordon sitting on a lounge smoking, and there were a number of other women sitting in the room.
Police said to Gordon: “Your mum doesn’t want you here, where can we take you?”
Gordon told police: “I’m [expletive] not going anywhere, I’m not going home.”
She then began screaming and swearing at her mother, who told her to leave.
The police asked the other people in the room where they could take Gordon but, before they could reply, Gordon pushed back a nearby coffee table.
Concerned Gordon may assault someone, police moved a nearby plastic chair away from her. Gordon then stood up and began yelling at her mother, saying: “I told you not to call the police.”
She then lashed out, grabbing the victim by her face and hair.
Police intervened, and Gordon punched one of the officers above the right eye with a closed fist.
Fearing they would be over-powered, police took out their capsicum spray but were not able to use it as other people in the room were obstructing them.
Gordon dragged her mother to the ground, pinned her down, yelling and shouting at her and hitting her on the head.
Police again tried to assist the victim, but Gordon kicked the officer above the knee.
Gordon’s mother then overpowered her and police handcuffed her, but she continued to resist police.
Eventually police were able to walk Gordon to the police vehicle. On the way she swore at them, and tried to spit on one of the officers.
On the trip to the police station she continued screaming and swearing at police, calling them “white [expletives]”, among other things.
At the police station Gordon continued to abuse officers and spat twice at one of the arresting officers.
Mr Allen convicted Gordon on all charges.
On the common assault charge she was placed on a Section 9 Bond for 12 months.
For resisting an officer in the execution of their duty she was fined $400. On both counts of assault an officer in the execution of their duty Gordon was placed on a Section 9 Bond for 12 months.
