Jason Edwin Brazel, 36, formerly of Piper Street, Bathurst and now of Eagle Vale, appeared before magistrate Michael Allen.
Police facts tendered to the court told how Brazel was driving his Ford along the Mitchell Highway at 12.05am on November 16 last year when his car left the road three kilometres from Bathurst and crashed into a ditch.
A passer-by stopped and checked on Brazel, before calling the police.
Police arrived, established Brazelas the driver and gave him a roadside breath test. It was positive and he was arrested for a breath analysis.
Police placed him in the back of a caged vehicle and took him to Bathurst Police Station for a breath analysis.
As they were entering him into custody, Brazel said to police: "Can't you just give me a break, can't you just let it slide?"
A breath analysis revealed a blood alcohol reading of 0.298 -almost six times the legal limit.
A police check revealed Brazel's licence was disqualified in the Bathurst Local Court on June 23,2014 for 30 months.
Police suspended his driver's licence and demanded he surrender it under Section 224.
On the high range PCA charge, Brazel was convicted and jailed for 10 months, wholly suspended under Section 12.
He was also disqualified from driving for three years from June 29, 2015, with his habitual offenders declaration quashed.
For driving a motor vehicle while disqualified, he was fined $600 and disqualified from driving for two years, from June 29, 2015.
