Lloyd Stephen Robinson, 39, of Barega Way, Kelso, appeared before magistrate Michael Allen.
Police facts tendered to the court told how Robinson was driving along Gilmour Street in Kelso at 10.56pm on April 16 this year when police noticed his vehicle moving from side to side in the lane.
Police activated their warning lights and pulled him over for a random breath test.
As police approached the car, they informed Robinson that their car was fitted with a camera system that was recording his conversation with police and his actions.
A roadside breath test produced a positive result.
Police arrested Robinson and took him to Bathurst Police Station, where he recorded 0.126.
He told police he had drunk six to eight schooners of Tooheys New between 7pm and 10pm and had not eaten any food.
References tendered to the court told how Robinson's marriage had just dissolved and he was not thinking well or making informed or responsible decisions.
He also attended the Traffic Offenders Program.
Mr Allen dealt with the matter by way of a Section 10 (1) (b) Conditional Discharge, placing Robinson on a Section 10 Bond for 18 months.
