Dane Romano Bandera, 27, of McBrien Drive, appeared before magistrate Michael Allen in Bathurst Local Court on February 1, charged with low-range PCA.
Police facts tendered to the court told how at 6.55pm on November 5 police were patrolling Rankin and Lambert streets when they observed a Nissan Navara driven by Bandera turn from Lambert Street into Rankin Street. As it moved into Rankin Street police observed the rear wheels of the vehicle lose traction, with the rear end of the car sliding sideways for a period before straightening.
Police activated their warning lights and pulled Bandera over, and he produced a C Class driver’s licence. A roadside breath test produced a positive result and he was arrested and taken to Bathurst Police Station for a breath analysis.
The court heard it was evident to police at the time of Bandera’s arrest he was affected by alcohol; his breath smelt of intoxicating liquor and his eyes were bloodshot. He recorded a reading of 0.062, placing him in the low range category.
Bandera told officers he had drunk three Jack Daniels between 4pm and 5pm, before being pulled over nearly two hours later.
