A MAN who defecated on a shopping centre floor has been convicted and fined for damaging property.

Adrian Paul Hotham, 21 – of William Street, Bathurst – did not appear before Bathurst Local Court to face the charge which was handled ex parte by magistrate Michael Allen.
The court heard how at around 9.06pm on February 19, Hotham and a friend walked into the Bathurst Chase Shopping Centre to use the toilets.
CCTV in the shopping centre captured the pair on video and the friend can be seen entering the cubicle while Hotham is captured outside the toilet door.
The footage shows him squatting, taking his pants down and defecating on the ground before walking away.
At 9.50pm, a security guard noticed human faeces at the front of the toilet door and immediately reviewed the security footage, which captured the incident and clearly identified the accused.
The officer did a patrol of the area and found Hotham in a hotel beer garden.
Police were called and reviewed the footage before going to the hotel to speak with Hotham.
As police approached, Hotham walked away and police called out for him to stop.
They informed him he was under arrest for malicious damage, handcuffed him and walked him back to the police car.
They questioned him about the incident and he admitted defecating on the floor.
“My friend was in the toilet and I was busting,” Hotham told officers.
As Hotham left the police station he became involved in an altercation outside with a friend who had been waiting for him.
Police used capsicum spray to end the confrontation and charged Hotham with behaving in an offensive manner.
On the destroy or damage property charge, Hotham was convicted and fined $400. For behaving in an offensive manner, he was also convicted and fined $400.
