Adam John Bell, 29, of Swanbrooke Street, Windradyne, appeared before magistrate Michael Allen in Bathurst Local Court, charged with mid range PCA.
The court heard on May 1 this year, at about 8.40pm, Bell was driving east along Howick Street. Police followed the vehicle for a short distance along George Street before stopping Bell for a random breath test.
Police asked Bell if he had consumed any alcohol and he told them: “I just finished one at Panthers.”
Police gave Bell a 10-minute window before submitting him to a random breath test, which produced a positive result.
He was arrested and taken to Bathurst Police Station for a breath analysis, where he recorded a reading of 0.089, placing him in the mid range.
Bell told police he had four schooners of beer, with his first drink at 5.30pm and his last drink at 8.30pm at Bathurst Panthers.
Police formed the opinion he was slightly affected by alcohol at the time.
The court heard Bell attended the Traffic Offenders Program, and references tendered to the court told how Bell deeply regretted his actions, which were out of character, and he had learnt a lesson.
Mr Allen convicted Bell, fined him $450 and disqualified him from driving for a period of six months.
