A MAN who smashed three windows of a neighbour’s house has been convicted of malicious damage and ordered to pay $600 compensation to the owner of the house.

Daniel Malvicino, 23, of Currawong Street, Bathurst, told police he had no memory of the incident when they arrested him in June. He appeared in Bathurst Local Court on June 6.
The court heard that at about 9pm on June 4 Malvicino had a heated argument with his girlfriend at his house in Currawong Street. Afterwards he walked out of his house carrying an aluminium chair.
He then walked to the front of 16 Currawong Street where he smashed three windows of the house before returning to his house. At the time the victim’s wife was inside the house and very fearful for her safety. The court also heard the victim had a personal violence order in place against Malvicino.
Police were called by a number of people in the street, but when they arrived Malvicino had left the scene.
At 11pm police were again called to the location and when they arrived they found Malvicino on the road with a jumper wrapped around his hand.
He was heard by police to say: “I’ve got a gun, so you’ll have to shoot me.”
As police approached he said to them: “I guess you want to arrest me.”
For destroying or damaging property, Malvicino was convicted and put on a Section 9 Bond for 12 months.
For contravening an AVO he was placed on a Section 9 Bond for a period of 12 months.
