A MAN who pushed his partner to the ground just weeks after she had undergone back surgery has been convicted of assault occasioning actual bodily harm, fined and put on a bond.

Michael James Berrisford, 44, of Cox Lane Eglinton, appeared before magistrate Michael Allen in Bathurst Local Court on June 27 to answer the charge.
The court was told Berrisford was at a neighbour’s house drinking before going home and getting into an argument with his partner about dinner.
During the fight Berrisford emptied the entire contents of the freezer onto the kitchen floor.
A heated argument between the two continued, and Berrisford placed both hands on the victim pushing her to the ground.
The victim managed to get up and the argument continued, with the victim telling police she punched the accused, believing he was going to assault her.
Using both hands Berrisford again pushed the victim and a struggle ensued; the victim was pushed up against the stove before falling to the ground, with Berrisford landing on her left hip.
She tried call police but Berrisford grabbed the mobile from her and threw it across the room, before she called police from the landline.
Police arrived and saw the victim's injuries which included a lump on the back of her head, 5.5cm in diameter and bruising on her elbow and right flank. At the time of Berrisford's arrest the victim was also being assessed for a possible broken jaw.
Mr Allen convicted Berrisford, fining him $650 and placing him on a Section 9 Bond for 15 months.
