A MAN who threatened to “[expletive] smash” his partner has been convicted of common assault and contravening conditions of an apprehended violence order.

Jason Robert Dove, 38, of Alfred Street, South Bathurst appeared in person and unrepresented before magistrate Michael Allen on June 27.
The court heard the victim had taken out an apprehended violence order against Dove back in April. She had contacted police about assaults which had occurred and police applied for and were granted an urgent AVO for the victim which was served on May 9.
Then on June 11, the victim and Dove were at the Farmers’ Arms drinking alcohol, before catching a courtesy bus to the Elephant and Castle Hotel.
The victim thought Dove was inside the hotel but later realised he wasn’t and caught a cab home.
She waited outside the house because she didn’t have a key, when she received a text from Dove telling her he was at The Eddy, so she went and met him there. An argument began and they walked off in different directions, before meeting at home.
The victim wanted Dove to sleep at another location, and they got into a fight with Dove pulling the victim’s hair, telling her “I’ll [expletive] smash you.”
At 2.45am the victim went to the police station to report the assault saying “I just can’t do it again.”
On the common assault matter, Dove was convicted and placed on a Section 9 Bond for nine months.
For contravening an AVO, Dove was fined $750 and placed on a Section 9 Bond for a period of 12 months.
