Alan Simmons, 19, had just turned 18 at the time police allege he dragged a woman (who was then aged 22) off Russell Street and into a paddock where he subjected her to a violent 90-minute sexual assault.
The woman was walking home alone on Russell Street at 5.50pm on August 1, 2015 when the assault allegedly occurred.
The court heard graphic details of the alleged assault and the types of injuries the victim received during the 90 minutes she was detained.
Magistrate Roger Clisdell heard from public defender barrister Ian Nash who disputed the number of aggravated sexual assault inflicting actual bodily harm charges his client had received.
“There are 10 allegations of assault, but only five injuries,” Mr Nash said.
“It was quite an inventive argument that I don’t agree with,” Magistrate Clisdell said of Mr Nash’s claim.
Mr Nash also disputed when, and for how long, the victim was detained.
“I don’t have any difficulty finding that the complainant was detained,” Magistrate Clisdell said.
The charges laid include taking and/or detaining person with intent to obtain advantage, three counts of assault occasioning actual bodily harm, eight counts of aggravated sexual assault inflicting actual bodily harm on victim and two counts of sexual intercourse without consent.
The committal hearing was adjourned to Penrith Local Court on November 4.
