Mark Relph, 36, of James Barnett Drive in Kelso appeared before magistrate Michael Allen in Bathurst Local Court on September 26, charged with mid range PCA.
Police facts tendered to the court told how at 2.35am on June 10 this year at Nowra, Relph was stopped by police on the Princes Highway.
The court heard he came under the notice of police as he was swerving all over the road, crossing over lanes as well as noticeably driving below the posted speed limit.
He was subsequently stopped for a random breath test.
After being stopped by police Relph submitted to a road side breath test which produced a positive result.
He was arrested and taken to Nowra Police Station where he had a breath analysis, recording a reading of 0.101.
Because the reading was in the mid range his licence was immediately suspended.
Relph requested a blood sample be taken following the breath analysis, which was done.
The court was tendered a reference written by his mum which told how the incident was out of character, and that Relph had a very strong work ethic, and was very remorseful for his behaviour.
Relph also wrote a letter to the court apologising for his actions, saying he was relived “no one was injured or affected by what I have done.”
Mr Allen dealt with the matter by way of a conditional discharge, placing Relph on a section 10 1 (b) good behaviour bond for 18 months.
