The Triple Eight Holden squad was on Thursday granted a 24-hour extension to submit the formal notice of appeal, along with evidence to support its case to have the penalty overruled.

Whincup finished Sunday's Bathurst 1000 first on the track, but was relegated to 11th after a 15-second penalty for causing an earlier collision was added to his race time.

The sanction handed victory to Will Davison, who was second across the line in his privateer Tekno Autosports Commodore after fending off a late challenge from Whincup's Red Bull Racing teammate Shane van Gisbergen.

The Triple Eight-run team lodged notice of its intention to appeal against the decision after the race, serving notice that it would officially contest the result by disputing the penalty.

It is seeking to have the time penalty either withdrawn fully or replaced by a deduction of championship points, which the team has asserted is the appropriate punishment for an unintentional crash.

The extension for formally lodging the protest, requested by Triple Eight, followed confusion about the deadline.

In a statement issued on Tuesday, the Confederation of Australian Motor Sport – the national governing body of motor racing, which administers the Supercars sporting rules – said Triple Eight had 92 hours from the finish of the Bathurst 1000 to submit evidence to support the appeal.

But on closer inspection of the regulations, it was found that the time allowance was actually 96 hours after the race, making the nominal deadline 5.30pm AEDT on Thursday instead of 1.30pm.

Amid the procedural error, Triple Eight applied to the CAMS-run Supercars National Court of Appeal for an extra day to submit its case, which was granted.

According to Triple Eight Holden team owner Roland Dane, the delay was to allow the tribunal to respond to the team's request for additional details concerning the appeal process.

Under the racing rules, the appeal is due to be heard within nine days of the Bathurst 1000, which means the three-person CAMS-appointed tribunal should sit by next Tuesday.

But the hearing, scheduled to be convened at CAMS' headquarters in Caulfield, Melbourne, can be delayed by mutual agreement, just as the location can be changed by joint consent.

The protracted lodgement of the proposed appeal means it is likely to be delayed until after the Gold Coast 600 at the end of next week.

In any event, a decision is unlikely before the GC600 even if the hearing goes ahead early next week as the Supercars National Court of Appeal has up to 14 days after the hearing to deliver its verdict.

If the appeal is successful, Whincup would be restored as the official winner, giving him a fifth Bathurst 1000 title.

He was penalised for running into Scott McLaughlin's Volvo S60 as he attempted a passing move late on lap 150 of 161, pushing the New Zealander off the track.

The incident triggered a collision between McLaughlin and Holden Racing Team veteran Garth Tander, whose Commodore ricocheted off Whincup's slowing car into McLaughlin as he rejoined the track.

The melee eliminated McLaughlin and Tander, who were both on course for podium placings, as Whincup continued and took the lead during the ensuing safety car intervention.

Whincup backed off after his collision with McLaughlin because the rules require offending drivers to redress following a collision – that is, give back the position gained by an illegal overtaking move.

Triple Eight contends that Whincup should not have been penalised because he didn't cause the contact with McLaughlin and, even if he were guilty, the time penalty was not consistent with previous sanctions for similar offences.

The team maintains that under the guidelines, Whincup should have been docked 10 championship points rather than adding 15 seconds to his race time.

As well as the muddled deadline, the time it was taking Triple Eight to lodge its formal appeal prompted speculation that Triple Eight was under pressure to drop the case because of the adverse reaction on social media.

Dane was adamant on Thursday that the appeal would go ahead.

"Absolutely, 100 per cent," he said. "We're just using all the time available.

"We're going through the due process. They have given us another 24 hours."
