TWO men accused of sexually assaulting a 10-month-old baby girl at a home near Bathurst remain behind bars.

Charges against the men were mentioned in Bathurst Local Court on Monday. The two men, both aged 50, cannot be identified for legal reasons.
Anthony Lynch, who is representing one of the men, told the court there was neither a need nor a wish for either of the accused to appear before the court.
Prosecutor for the DPP, Felicity Martin, told the court the matter required a balance of brief order as there were a number of items still outstanding.
Magistrate Michael Allen adjourned the matter and ordered the balance of brief be served by November 28 for replies on December 12. He formally refused bail for both accused.
The men were arrested in Ivanhoe, Victoria on July 5.
One of the accused, who is the father of the child, has been charged with two counts of sexual intercourse with a person under 10 years and the production, possession and sharing of child pornography.
The other man, the father's partner, has been charged with sexual intercourse with a person under 10, child pornography-related offences and use of a child under 14 to make child abuse material.
It's alleged the men travelled to look after the baby for three hours in a small town in the Central West on April 19, 2015 while her mother was at a training course.

Police allege the men sexually abused the 10-month old over those three hours and allegedly took photos of her that they later uploaded to their computers.
Police will allege that, in a Skype conversation two days later, the father's partner spoke to an associate and said: “Her mother was out for a while. We did not have enough time to do everything that we wanted to unfortunately.”
He also allegedly said: “I want to drug the little one and really have a good time.”
He didn't say if the mother knew what had happened but allegedly said: “The mother is a [expletive] bitch … and I hate her.”
