Darren Robert Draper, 47, of Edgell Lane, Bathurst, appeared in person and unrepresented last month before magistrate Michael Allen, charged with drive with a mid-range PCA
Police facts tendered to the court told how on December 18 last year police were patrolling south along Hereford Street when they pulled Draper over for the purpose of a roadside breath test.
He was directed by police to provide his driver’s licence, which he produced telling police “he had only just finished a beer”.
He was afforded a 10-minute waiting period for the alcohol to subside, but then returned a positive road side breath test.
Police also noted his eyes were bloodshot.
He was arrested for a breath analysis, and taken to Bathurst Police Station recording a reading of 0.094.
He told police he had consumed two full strength stubbies of Toohey’s New between 1pm and 4pm and not eaten any food.
Mr Allen convicted Draper, fined him $450 and disqualified him from driving for a period of six months.
