Rush did not appear during the brief mention; his solicitor Shane Cunningham, indicating he would be contesting the charge.
Rush was originally charged with low range drink-driving back in February, to which he has entered a guilty plea.
The charges related to his arrest on February 24, when Rush, 62, blew a low-range reading of 0.066 after he was stopped by police on Panorama Avenue about 11.30pm.
Three days later he resigned from his role as Bathurst Regional Council mayor.
The speeding charge, drive at more than 30km/h over the limit was added by Bathurst police a few days after his initial court appearance.
In court on Monday, Mr Cunningham said his client had already entered a plea of guilty to the drink driving matter but said he was entering a not guilty plea in respect the speeding charge. He requested a date for hearing.
The court heard two police witnesses would be called to give evidence, with the matter expected to take around 90 minutes.
A short in car-video is also going to be shown during the hearing.
The matter will be back before the Bathurst Local Court on September 27.
