A MAN caught drink driving with two children in the car has been disqualified from driving and fined $450.

Brian Alan Bell, 34, of Cummings Street in West Bathurst, appeared in person and unrepresented before magistrate Michael Allen in Bathurst Local Court earlier this month charged with low range PCA.
Police facts which were tendered to the court told how on April 8 this year, at around 5.13pm, Bell was driving easterly on the Mitchell Highway, when he was stopped by police who were performing stationary breath tests east of the intersection of Alexander Street.
He produced his driver’s licence, and as police were speaking to him they observed there were two children, aged six and 10, in the car with him.
While speaking with police, they noticed intoxicating liquor could be smelt on Bell’s breath.
He told officers he had been drinking between midday and 4.30pm.
He was subjected to a roadside breath test, which produced a positive result, and he was arrested for the purpose of breath analysis.
At the police station he told officers he had drunk between four and five rum and colas, and his breath analysis recorded a reading of 0.062.
He told police he had driven from his home address in West Bathurst to his work in the industrial park after receiving a work call out.
He was returning home when he was stopped by police, who firmed the opinion he was affected by liquor.
Mr Allen convicted Bell, disqualifying him from driving for four months and fining him $450.
