A DRIVER who deliberately tried to avoid a random breath testing station has been convicted of drink driving and disqualified from driving.

Daniel Owen Ford, 35, of Gilmour Street in Kelso appeared before magistrate Michael Allen in Bathurst Local Court to answer two charges: driving with low-range PCA and driving across dividing lines while performing a U-turn.
Police facts tendered to the court told how at 3.10pm on April 22 this year at Kelso, Ford was stopped by police after trying to avoid a random breath test.
Police were doing random breath testing and Ford could be seen to pull into the kerb and stop.
Police watched the vehicle as they continued to pull in other drivers in to be tested.
As soon as the vehicles stopped the accused took his opportunity to do a U-turn over double unbroken lines to avoid the testing site.
Police returned to their vehicle, activating all warning devices,and proceeded after the vehicle with the driver attempting to allude police. However they stopped him and removed the driver from the car.
Ford admitted that police that he did intentionally avoid the breath testing site as he was worried he wold go over the limit.
A roadside breath test produced a positive result.
He was arrested and taken back to Bathurst police station where he admitted to drinking six bottles of Corona and Hahn between 1am and 3pm.
He recorded a blood alcohol reading of 0.078.
On the drink driving matter Ford was convicted and fined $350 and disqualified from driving for three months to date from May 29.
The second charge; drive across diving lines doing a U-turn was dealt with by way of a Section 10 (1) (a).
