Brad Kerr, 35, of Parsons Place, West Bathurst, appeared before magistrate Michael Allen in Bathurst Local Court to answer a charge of high-range PCA, second plus offence.
The court heard how Kerr was stopped by police at around 6.30pm on New Year’s Eve last year and recorded a blood alcohol reading of 0.177 following a breath analysis.
Police saw Kerr driving his white Ford Ranger and he was stopped in Hope Street for a random breath test.
Police noticed the smell of intoxicating liquor on his breath, and he told officers he had had a couple of drinks at home.
A breath test produced a positive result and he was arrested and taken back to Bathurst Police Station for a breath analysis.
While in custody, Kerr admitted to drinking seven cocktails of margarita between noon and 5pm and not eating any food.
Police said he was argumentative and belligerent the entire time he was in custody.
Mr Allen convicted Kerr, fining him $800 and disqualifying him from driving for nine months. He was placed on an interlock order for 48 months. He was also placed on a Section 9 Bond for a period of 18 months, and ordered to accept the supervision of community corrections.
