A SUSPENDED driver caught driving his friends to get their methadone, while he himself had an illicit drug in his system, has been disqualified for three months.

Brett William Lucas, 35, of McMenamin Place, Kelso, appeared before magistrate Michael Allen in Bathurst Local Court on June 5, charged with driving while suspended and with an illicit drug in his system.
The court heard how Lucas was pulled over in George Street on February 24. Police asked why he was driving and he said: “I’m just taking them up to get their ’done [methadone] and then I’m going to the RTA.”
The accused was referring to three other persons in the car, one of whom held a full driver’s licence.
Lucas was given a breath test, which came back negative, and was then subject to an oral fluid test, which returned a positive detection to cannabis and methamphetamine. He said he had smoked “cannabis and meth two nights ago”.
For driving a motor vehicle while his licence was suspended, his licence was suspended for three months. For driving with illicit drugs in his blood, he was convicted under Section 10A and disqualified from driving for three months (concurrent).
