The Protection of the Environment Operations Act 1997 (POEO Act), section 96 and section 264, obliges council to control offensive noise in its area.
According to the NSW Environment Protection Authority, council is the appropriate contact authority for noise control.
Two council staff members attended my place and neighbourhood on October 17, 2017 at 3pm, where the Metro Cinemas Bathurst is emitting its heating, ventilation and air-conditioning (HVAC) noise seven days each week from midday (some days from 8am) until 10pm constantly.
This noise is caused by a faulty vibrating ventilation fan motor located on the cinema roof.
Council, instead of forcing cinema management to call a HVAC technician to fix the fan and stop the noisy vibrations, has stated there is no offensive noise. Case closed.
