Chantelle Skyelee Alberts, 34, of Minna Road in Bathurst, appeared in person before magistrate Michael Allen on November 13 charged with mid-range PCA.
She had a blood alcohol reading of 0.149, placing her in the mid range.
Police facts tendered to the court told how police were patrolling Sydney Road, Kelso in the early hours of September 10, 2017 when they saw a Nissan Pathfinder making a left-hand turn from Littlebourne Street on to Sydney Road, Kelso.
The vehicle travelled slowly in lane one before drifting into the fog line, slowing down.
Police activated the warning lights on their highway patrol vehicle and indicated to Alberts to pull over.
Police approached the vehicle, spoke to the driver and then questioned Alberts in relation to the consumption of alcohol.
The accused told police she had consumed two drinks at a friend’s place and thought she was right to drive.
The accused was unable to produce a valid driver’s licence, telling police she didn’t carry a purse with her.
A roadside breath test produced a positive result and Alberts was arrested for the purpose of a breath analysis, which recorded 0.149.
When questioned again about her consumption of alcohol, Alberts said she had consumed a few mouthfuls of Wild Turkey.
Police attempted to establish with the accused the location of her driver’s licence and she said it was in her purse in the vehicle.
The licence, a current Queensland driver’s licence, was located a short time later. In the car, police also located a 750ml Wild Turkey bottle with only minimal contents remaining.
Mr Allen convicted Alberts, disqualifying her from driving for six months, with Section 225 of the Road Transport Act to apply
He also placed her on a Section 9 bond for eight months.
