Christopher Mark Hogan, 31, of Laffing Waters, appeared before magistrate Michael Allen in Bathurst Local Court to answer the charge against him.
Police facts tendered to the court told how Hogan was stopped by police in Gilmour Street at 4.40pm on October 28 this year.
Police attached to Chifley’s Highway Patrol unit were patrolling Gilmour Street at the time.
As they were travelling south, they saw the white ute that Hogan was driving cross on to the oncoming lane and pull over on the eastern side of the road on the opposite side of the street.
Police stopped their vehicle in front of his ute and Hogan got out of the ute and began looking at the front of the vehicle.
Police approached Hogan, who said he had stopped by the side of the road because there was something wrong with his vehicle.
Officers asked why he had crossed to the opposite side of the road rather than drive 50 metres up the road and pull over on the correct side. Hogan did not answer.
Police asked if he had been drinking and he said he had consumed two schooners of beer.
Officers introduced themselves and gave him a roadside breath test.
It returned a positive result.
Hogan was arrested for a breath analysis recording and, back at Bathurst Police Station, returned a reading of 0.133.
He told officers he had consumed five schooners of full strength Tooheys New at Paddy's Hotel between 1.30pm and 4.30pm.
He said he did not have any food during this time when he was drinking.
The court also heard he was remorseful and compliant with police.
Mr Allen convicted Hogan, disqualifying him from driving for 12 months, and placing him on a Section 9 bond for 12 months.
He also has to accept Community Corrections supervision.
