The driver, Craig Gregory Wallace, 26, of Ogilvy Street, Blayney, appeared before magistrate Michael Allen in Bathurst Local Court charged with low-range PCA.
Police facts tendered to the court told how police were patrolling the Mid Western Highway on October 29, 2017 when they stopped Wallace for exceeding the speed limit.
They asked for his licence, which Wallace produced, and when they questioned him about why he was speeding, he said to officers: “I don’t even know, sorry.”
A breath test produced a positive result and Wallace was taken to Blayney Police Station, where he recorded 0.072 after undergoing a breath analysis, placing him in the low-range category.
In relation to his drinking, he told police he had drunk 12 full strength schooners of beer the previous evening at a wedding in Parkes, with the last being about 12 hours prior to him being stopped.
The court also heard he did not consume any food during that time, however, he had eaten breakfast the morning he was pulled over by police.
Police noted throughout the process the accused was remorseful for his actions and police had no negative comments regarding their interaction with him.
He was issued with a Field Court Attendance Notice for the offence and also an infringement notice via MOBIPOL for the speeding offence.
Mr Allen convicted Wallace on the low-range PCA charge.
Wallace was fined $440, and disqualified from driving for three months.
