Gregory John Lynch, 65, of Davys Plains Road, Cargo, appeared before magistrate Michael Allen in Bathurst Local Court charged with low-range PCA.
The court heard how Lynch was one of a number of drivers directed into a police site conducting random breath tests on the Sydney Road.
Police approached the driver’s window of Lynch’s car and he was asked to produce his driver’s licence, police facts said. He underwent a roadside breath test, which produced a positive result.
He was arrested for the purpose of a breath analysis and was escorted on foot to police van RBT24, which was set up and operating on site.
The accused underwent a breath analysis which returned a reading of 0.053, police facts said.
While speaking to the accused, police noticed his breath smelled slightly of liquor.
Mr Allen dealt with the matter by way of a Section 10 conditional discharge (1)(b).
