Daniel John Devjak, 27, of Turondale Road, Turondale, appeared on a charge of driving furiously, recklessly or at a speed or in a manner dangerous before magistrate Michael Allen in Bathurst Local Court on Monday.
Police facts tendered to the court told how Devjak crossed unbroken lines to overtake another car at speed on May 24 last year and, having overtaken the vehicle, jammed on his brakes.
The witness told police he was driving along Turondale Road at a speed of 90 to 100 kilometres an hour and negotiating a bend in the road when he saw a vehicle being driven by the accused approaching the rear of his car at a rapid speed.
That speed was estimated by the witness to be in the vicinity of 130km/hr – well above the signposted limit.
The witness told police the accused crossed double unbroken lines and overtook his vehicle at high speed.
The witness said he flashed his vehicle’s high beam lights due to the danger posed by Devjak’s driving.
After the witness flashed the vehicle lights, the accused applied his vehicle’s brakes so harshly that his vehicle almost came to a stop, forcing the witness to brake harshly to avoid a collision.
Devjak then accelerated harshly away from the vehicle at high speed, the police facts said.
The entire incident was recorded on a camera mounted on the windscreen of the witness’ vehicle. The footage was downloaded and provided to police.
The following day, Devjak was stopped by police who were patrolling Turondale Road.
He underwent a breath test, which produced a negative result.
Regarding the previous day’s incident, Devjak admitted to police he had “brake-checked” the other car by applying a “light jab” on his brakes.
When asked about the danger of his actions, Devjak admitted it was “one hundred per cent very stupid” but said “you don’t think about it when you’re raging”.
