The man, Scott Andrew Hailstone, 37 was convicted after pleading guilty to a charge of common assault last week before relieving magistrate James Garbett at the Bathurst Court House.
Police prosecutor Sergeant Brett Donaghy tendered a statement of facts that Mr Garbett took into account when he sentenced Hailstone, of Trumper Place, Bathurst.
Mr Garbett said the offence warranted a gaol sentence but he was prepared to impose a community-based order for Hailstone to report to the Probation & Parole Service within seven days and work unpaid for 150 hours.
Hailstone and the woman had been drinking at a West Bathurst residence about 9pm on August 22, the statement said. He had thrown household items from a verandah to a roadway, and the woman victim had removed his clothes from the house.
Police said Hailstone punched the woman's mouth with a closed fist. A scuffle ensued and Hailstone took a 750ml Tooheys beer bottle and hit the back of her head, breaking the bottle. He then put the bottle to the woman's throat and made threats.
The woman had made her escape from the house with children in car and drove to Bathurst Police Station to report the incident.
