A MAN who drove recklessly, crashed his car, told police someone else was driving and then altered his blood alcohol content before giving police a blood sample has been jailed by Bathurst Local Court.

Garry Wayne Dick, of Lithgow, appeared before Magistrate Jan Stevenson, who said Dick must be jailed for his outrageous driving and then lying to police.
Dick was the driver of a car which crashed while travelling at a speed between 160 kilometres an hour and 180km an hour at Hartley on January 3 this year.
When police arrived he told them his brother was driving the car, and subsequently did not submit to a blood analysis at the time of the crash. By the time it became apparent he was the driver, he had gone home and told police he drank a hip flask of rum, which affected his blood alcohol sample.
Ms Stevenson said falsely naming his brother in a crash which could have killed not only Dick, but also his three passengers, “eats at the heart of any system of justice”.
She also noted Dick was on a Section 9 Bond when the offence occurred.
Dick’s solicitor Paul Reynolds admitted the behaviour of his client, who has a history of drink-driving and driving while disqualified, was stupid.
“Four people could have easily been killed. The car went 37 metres through the air; it was a total write-off,” he said.
Mr Reynolds said his client’s decision to drive was a “spur of the moment” thing.
“He and three friends decided to drive to Sydney to go to the beach.”
In sentencing, Ms Stevenson said the Section 9 Bond Dick was on at the time of the offence had to be called in.
She said Dick was lucky his passengers were not dead or maimed.
On the charge of altering his concentration of alcohol, Dick was jailed for 12 months from October 28, 2011 and disqualified from driving for one year.
On the charge of driving recklessly he was jailed concurrently for nine months, from October 28, 2011, and disqualified from driving for a period of five years.
On the charge of making a false accusation he was sentenced to nine months imprisonment, cumulative, starting on October 29, 2012.
