Toole's solicitor Shane Cunningham applied to Magistrate Michael Allen to have the matter withdrawn.
Crown prosecutor Sergeant Brett Doherty told the court that telephone records given to police did not support the assertions made by Hyder regarding Toole.
He agreed the matter should be withdrawn and dismissed.
