Samuel Peter Bates, 21, of Bouffler Close, Kelso did not appear before Magistrate Michael Allen in the Bathurst Local Court on May 14, instead providing the court with a written plea of guilt to the charge of driving with low-range PCA.
Police facts tendered to the court told how at 8.20pm on April 12, Bates was pulled over by police in Kelso.
The accused was driving his ute along Bonnor Street. He was stopped for the purpose of a random breath test and produced his licence.
The breath test returned a positive reading. He was arrested and taken to Bathurst police station for breath analysis where he returned a reading of 0.063. The accused told officers he had consumed one long neck of Toohey’s New beer in the afternoon and had eaten dinner.
At about 7.45pm he got a text message from a friend asking him if he could drive him home.
Bates was convicted, fined $440 and disqualified for three months.
