Aaron Logan, 24, of View Street, Kelso, did not appear to answer the charge in Bathurst Local Court and it was dealt with in his absence.
He was convicted and disqualified from driving for six months.
Police facts handed to the court outlined how Logan was on his bicycle travelling north along Currawong Street towards Lloyds Road on December 13 last year when he lost control of his bike, collided with the gutter and was thrown off the bike and on to the footpath.
Logan, who wasn’t wearing a helmet, sustained head and spinal injuries in the crash.
A number of witnesses ran to Logan and rendered first-aid, according to the police facts, and the SES was notified, as its office is across the road from where the crash occurred.
SES volunteers assisted and contacted emergency services.
A witness told police Logan had been at his house since noon drinking beer. He said the accused left, got on his bike, headed down the hill and got the wobbles as he got to the intersection.
Logan hit the gutter and landed on the concrete, the witness said.
A second witness said they saw the accused pass the house on his bike and heard a loud crash a few moments later. They said they ran out and found the accused unconscious.
After assessment by paramedics, Logan was transported by air ambulance to Westmead Hospital for treatment.
A sample of blood was taken at 11.10pm. It was later analysed and the concentration of alcohol present was not less than 0.201.
Logan later attended Bathurst Police Station and spoke with police.
He told police he began drinking at 10am on December 13 and his last drink was 3pm.
Logan said he felt tired, heavy and dizzy after consuming the beer and it took him approximately half an hour to get on his bike.
