A MAN who had a few drinks, plus an alcoholic dessert, has been convicted of special range PCA after he was pulled over by police and charged.

Robert Craig Daniels, 25, of Boyd Street, Bathurst, was convicted, fined and disqualified from driving after a brief appearance before magistrate Michael Allen in Bathurst Local Court.
The court heard how Daniels was stopped at South Bathurst on March 8 this year and recorded 0.031.
Police facts tendered to the court told how police were parked at the intersection of Rocket and Seymour streets at 12.55am on March 8 when they saw a silver Toyota Corolla driving at excessive speed along Rocket Street towards Havannah Street.
Police did a U-turn and located the vehicle a short distance away in the middle of the road in Heylin Place.
Police approached the vehicle and found Daniels in the driver’s seat.
They say he produced a NSW P1 licence and submitted to a roadside breath test, which produced a positive result.
He was arrested by officers and taken to Bathurst Police Station for a breath analysis, which recorded 0.031.
In relation to his consumption of alcohol, police facts said the accused stated he had consumed a couple of drinks around lunchtime and then had four small vodkas and an alcoholic dessert cake between 2pm and 12.30am.
According to the police facts, the accused seemed to be slightly affected by alcohol, but was co-operative with police.
He was issued with a field court attendance notice for driving with a special range PCA (first offence).
Mr Allen convicted Daniels, fining him $330 and disqualifying him from driving for four months.
