A SUSPENDED driver caught driving with an illicit substance in his blood and carrying one gram of methylamphetamine in his car has been convicted, fined and disqualified from driving for three months.

Justin Dale Brennan, 34, of Napoleon Street, Raglan, recently appeared before Magistrate Clisdell in Bathurst Local Court.
The court heard police stopped Brennan in Alma Street on Sunday, May 20 and he was asked to produce his licence, which he did not do.
The accused said: “I know I was suspended but I thought it was fixed.”
Police saw that the accused’s pupils were dilated and his hands were shaking as they spoke with him.
A breath test was negative and the accused was subjected to an oral fluid test which produced a positive detection to cannabis and meth. He was arrested for the purpose of a secondary oral fluid test.
Police also searched the car and found a clear resealable bag containing one gram of methylamphetamine. Police seized the substance, and Brennan said: “It's mine - it doesn’t look good, does it.”
He was taken to Bathurst police station and asked a number of questions before providing a sample of oral fluid for analysis, which returned a negative result to THC and meth. The remainder of the sample was sealed and sent away for analysis.
In relation to the taking of drugs the accused said to police: “I had some a couple of days ago.”
At the station, police made inquiries about the status of the accused's licence revealing it was suspended.
The oral fluid sample sent for analysis later returned a positive result to meth and delta 9 (cannabis).
On the charge of possessing a prohibited drug, Brennan was convicted and fined $200. For driving while his licence was suspended he was convicted and disqualified from driving for three months from September 10, 2018.
For driving with an illicit substance in blood, Brennan was convicted and disqualified for three months from September 10, 2018.
