A DRIVER who admitted to police he smoked drugs “every now and again” has been convicted and fined after appearing before Bathurst Local Court.

Adam Jarrod MacDonald, 26, of Sundown Drive in Kelso, appeared in person and unrepresented before magistrate Cate Follent, charged with driving with an illicit drug present in his blood.
MacDonald pleaded guilty to the offence, which occurred at 2.50pm on October 18, 2018 at Robin Hill.
Police facts tendered to the court told how MacDonald was stopped by police on the Mid Western Highway at Robin Hill after he was the subject of a driving complaint.
When police pulled him over, they asked him to produce his licence and he gave officers a NSW P2 licence.
The accused’s roadside breath test was negative, according to the police facts. He was then given an oral fluid test, which returned a positive detection to cannabis.
MacDonald was arrested at the scene for the purpose of a secondary oral fluid test and taken to Bathurst Police Station.
MacDonald provided the sample to police, which returned a positive result to cannabis.
The remainder of the sample was placed in a sealed vial in front of MacDonald and sent to the NSW Forensic Analytical Science Service at Lidcombe for analysis.
In relation to taking illegal drugs, MacDonald told police he smoked “every now and again”, according to the police facts.
The oral fluid sample sent for analysis returned a positive detection for cannabis, and MacDonald was given a court attendance notice.
Ms Follent convicted MacDonald of the offence, fining him $350 and disqualifying him from driving for three months.
